Terms of Use

These terms govern your use of KeyField, a service of Adaptiv Data LLC (“we” or “us”). By signing in, you agree to them. If you use KeyField for a company, you confirm that you may accept these terms for it, and “you” includes that company. Our Privacy Policy explains how we handle personal information.

1. The service

We may change, suspend or discontinue any part of KeyField at any time.

2. Your account

Each account is for one person. Keep your sign-in private, don’t let others use your account, and tell us at support@adaptivdata.com if you believe it has been used without permission. You are responsible for activity under your account.

3. How you may use KeyField

You may use KeyField and its information for your own real-estate business. You may not:

• sell, share, publish, sublicense or otherwise provide KeyField information to anyone outside your business;
• use it to build or supply a competing product or service;
• copy it in bulk, or access KeyField with bots, scrapers or other automated tools;
• interfere with or get around KeyField’s security or access limits; or
• use it to harass, threaten, deceive or discriminate against anyone, or for any unlawful purpose.

4. Not a consumer report

We are not a consumer reporting agency, and KeyField information is not a consumer report under the Fair Credit Reporting Act. You may not use it, in whole or in part, as a factor in deciding whether anyone qualifies for credit, insurance, employment, housing, a government license or benefit, or any other purpose covered by that law, or combine it with other information in a way that would make it a consumer report.

5. Contacting people

You are solely responsible for how you contact anyone you find through KeyField and for complying with all laws that apply to calls, texts, emails and mail, including the Telephone Consumer Protection Act, federal and state do-not-call rules, and the CAN-SPAM Act. This includes checking numbers against do-not-call lists, obtaining any required consent, and honoring requests to stop contacting someone.

6. Accuracy

KeyField information comes from public records that may contain errors or be out of date. We don’t guarantee that it is accurate, complete or current. Verify it before you rely on it. KeyField is not legal, tax or financial advice.

7. Ownership

KeyField, including its compilation and presentation of information, its software, name and design, belongs to Adaptiv Data LLC. These terms give you a limited, revocable right to use KeyField as described above, which ends when your access ends.

8. Fees

If you buy a paid plan, its price and billing terms will be shown to you before you pay.

9. Disclaimers

KeyField is provided “as is” and “as available.” To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

10. Limit on our liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or deals, arising from KeyField or these terms. Our total liability for all claims is limited to the greater of the amount you paid us for KeyField in the 12 months before the claim or $100.

11. Your responsibility to us

You agree to defend and pay for any claim, loss or expense, including reasonable attorney fees, that we face because of your use of KeyField, your contact with anyone you found through it, or your breach of these terms.

12. Ending access

You may stop using KeyField at any time. We may suspend or end your access at any time, including if you breach these terms. Sections 3 through 7 and 9 through 13 continue to apply after your access ends.

13. Governing law

Georgia law governs these terms, without regard to its conflict-of-law rules. Any dispute will be decided in the state courts of Cobb County, Georgia, or the federal courts for the Northern District of Georgia.

14. Changes to these terms

We will post changes here and update the effective date. We will notify you before a material change takes effect. Using KeyField after a change takes effect means you accept it.
